1.Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Mail Identity AI ("Mail Identity AI," "we," "us," or "our") governing your access to and use of the Mail Identity AI website, application, and related services (together, the "Service"). By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.
2.The Service
Mail Identity AI is an online tool that lets you design, generate, and export animated and static email signatures. Features, templates, plans, and availability may change over time as we improve the Service.
3.Your account
You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You agree to provide accurate information and to keep it up to date.
4.Plans, free trial, and billing
- Free plan. A free tier is available and includes a small "Made with Mail Identity AI" attribution on exported signatures.
- Free trial. Paid plans may be offered with a 7-day free trial. Unless you cancel before the trial ends, the trial converts into a paid subscription and the applicable fee is charged.
- Subscriptions. Paid plans are billed on a recurring basis (for example, monthly) at the price shown at checkout. Subscriptions renew automatically until cancelled.
- Cancellation. You may cancel at any time from your account or by contacting us. Cancellation stops future renewals; access continues until the end of the current billing period.
- Refunds. Except where required by law, fees already paid are non-refundable. Taxes may apply.
- Payment processing. Payments are handled by our third-party payment processor. We do not store your full card details.
5.Acceptable use
You agree not to use the Service to create or distribute unlawful, deceptive, infringing, or harmful content; to impersonate others; to send spam or violate anti-spam laws; to upload content you do not have the rights to use; or to interfere with, reverse engineer, or attempt to gain unauthorized access to the Service.
6.Your content
You retain ownership of the names, images, logos, links, and other materials you provide ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, store, process, reproduce, and display Your Content solely to operate and provide the Service to you (for example, to generate and deliver your signature). You represent that you have all rights necessary to provide Your Content and to grant this license.
7.Our intellectual property
The Service, including its software, design, templates, animations, text, graphics, and the Mail Identity AI name and logo, is owned by Mail Identity AI and protected by copyright, trademark, and other laws. Except for the rights expressly granted to you, we reserve all rights. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.
8.Service availability, changes, and discontinuation
We work hard to keep the Service available and, for active subscribers, to keep hosting the assets that make your signature display and animate, for as long as we operate the Service. That said, the Service is provided on an "as available" basis. We may add, change, suspend, or discontinue any feature or part of the Service — or the Service as a whole — at any time, including for business, technical, legal, or operational reasons.
If we decide to discontinue the Service entirely, we will make commercially reasonable efforts to notify active subscribers in advance and to stop charging recurring fees. To the maximum extent permitted by law, we are not liable to you or to any third party for any modification, suspension, price change, or discontinuation of the Service or any part of it.
9.Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that signatures will display or animate identically across every email client, device, or provider, which we do not control.
10.Limitation of liability
To the maximum extent permitted by law, Mail Identity AI and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the claim, or fifty U.S. dollars (USD $50).
11.Indemnification
You agree to indemnify and hold harmless Mail Identity AI from any claims, damages, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
12.Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
13.Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
14.Governing law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Illinois, unless otherwise required by applicable law.
